1.1 E-notary.in is a digital platform that allows users to publish documents for Defensive Publication, ensuring that such documents remain part of the public domain and cannot be patented by others.
1.2 This service does not provide legal notarisation as defined under the Notaries Act, 1952. Instead, it is an electronic documentation platform aimed at preserving prior art for intellectual property protection.
2.1 E-notary.in does not function as a legally recognized notary public under the Notaries Act, 1952. We do not offer attestation or authentication services for legal documents, affidavits, or other official records.
2.2 Our services strictly focus on Defensive Publication as per the guidelines of the Indian Patents Act, 1970, making innovations publicly accessible to prevent patent monopolization.
2.3 Users must ensure that their uploaded documents comply with applicable Indian laws, including data protection regulations under the Information Technology Act, 2000 and other relevant statutes.
3.1 Users must ensure that they have legal rights to publish the content they submit. Any content that infringes on copyright, trademark, trade secrets, or confidential agreements is strictly prohibited.
3.2 E-notary.in is not responsible for verifying the authenticity, legality, or correctness of uploaded documents. Users are solely responsible for their submissions.
3.3 Users must not upload:
- Any false, misleading, defamatory, or illegal content.
- Any personal, confidential, or sensitive information unless they have legal authority to make it public.
- Any fraudulent, plagiarized, or deceptive materials.
4.1 Documents submitted to E-notary.in for Defensive Publication will be made publicly accessible. Once published, such documents become prior art and may not be removed or modified to ensure their validity in preventing patent monopolization.
4.2 Users may voluntarily discontinue using the services at any time. However, any documents already published will remain publicly accessible as part of the Defensive Publication process.
4.3 E-notary.in reserves the right to modify, suspend, or discontinue services at any time, without any obligation to maintain published documents indefinitely. While our goal is to provide long-term accessibility, we do not guarantee lifetime service availability.
5.1 Users retain ownership of their submitted documents but grant E-notary.in a non-exclusive, irrevocable, worldwide, royalty-free license to host, display, and distribute the content as part of the Defensive Publication process.
5.2 Once a document is published, it cannot be withdrawn or altered to maintain its validity as prior art.
6.1 E-notary.in is a facilitation platform and does not offer legal advice or guarantee the effectiveness of Defensive Publications in preventing patent claims.
6.2 We shall not be held liable for:
- Any legal disputes arising due to the publication of user-submitted documents.
- Any financial loss, damages, or claims arising from reliance on published materials.
- Any technical failures, security breaches, or service interruptions beyond our control.
7.1 E-notary.in reserves the right to suspend or terminate a user's access without prior notice in cases of:
- Violation of these Terms and Conditions.
- Uploading illegal or infringing content.
- Misuse of the platform for fraudulent purposes. 7.2 E-notary.in may discontinue its services at any time, without liability to maintain past publications indefinitely. While we strive to provide long-term access, users should understand that service continuity is not guaranteed.
8.1 These Terms and Conditions are governed by and construed under the laws of India
8.2 Any disputes arising from the use of E-notary.in shall be subject to the exclusive jurisdiction of the courts in [City, State].
